What is Probate?
When a person dies, the named Executors in their Will are responsible for administering and dealing with their estate. Probate is the process to establish what the deceased person owned at their death - their property, assets and posessions.
Even when someone dies “Intestate”, i.e. without a Will, Probate is still legally required, although the process is known as Administration.
Probate can be a complex and onerous process, requiring a great deal of time and responsibility by Executors. In addition to handling the assets and liabilities of the deceased’s estate and preparing the legal and tax documents, the Executor is legally and financially liable for any mistakes, such as errors in tax returns, or incorrect distribution of assets.
